Some people are amazed that Barack Obama is said to have taught the Constitution as a professor. Let me offer a suggestion. Just because one teaches it in a university does not necessary mean that one understands it. Obviously, from what we have seen from Barack Obama, he doesn’t have a clue about the original intent of the founding document of the United States, much less care about adhering to it. He has violated it with the signing of many executive orders, numerous laws, including the Affordable Care Act, and now he’s done it again with his insurance fix.
Understand that Congress is the law writing branch of the federal government. If they don’t write law, then the Executive Branch has no authority to change law. The Executive is charged with law enforcement.
My goodness, even Democrat hyperboy Howard Dean asked that question:
Dean isn’t exactly a flaming conservative.
While the Executive does have certain discretions as to priority in prosecuting lawbreakers, he does not have discretion when it comes to enforcing the law. However, this is what the Obama administration has constantly been doing, not only with the socialized medicine law, but also with illegal immigration laws, the Defense of Marriage Act, and countless other laws.
Whatever laws are on the books, the President (and you don’t know how hard it is for me to refer to Obama as that, considering I believe him to be a usurper) is charged with taking care “that the Laws be faithfully executed,” according to Article II, Section 3 of the US Constitution. He cannot provide people with waivers from a law. He cannot change or alter the law in any way. He must execute it.
Ken Klukowski at Breitbart, expounds upon the “Take Care Clause”:
Among other things, the Take Care Clause was inserted in the Constitution to abolish the Royal Prerogative that the Framers of the American Constitution knew from their lives as Englishmen. It was the power of the king of England to disregard or effectively suspend Acts of Parliament. The king could not make laws, but he could shelve a law that Parliament had passed.
Obama’s announcement is a flagrant and undeniable violation of his constitutional duty under the Take Care Clause. The provisions of Obamacare causing enormous trouble for insurance plans are mandatory, and only Congress can change those parts of the Affordable Care Act. Every day provides additional proof that Obamacare is a complete train wreck, but it is one regarding which only Congress can change the terms.
This president’s relationship to Congress is reaching toxic levels, due in large part to the regularity of his hyper-partisan rhetoric and ongoing disrespect. He is learning that the campaign tactics that enabled him to win two presidential elections are manifestly counterproductive when applied to the arduous task of governing, especially in a country as large and diverse as America.
So, who will hold Obama accountable for his Constitutional violations? I’m not counting on Congress, though they have a duty to do just that. Many of them are just as guilty of violations of the Constitution as Barack Obama.
I wonder who will take on his unconstitutional acts in federal court.
You may ask, “Well, what difference does it make because the House approved legislation that would do what Obama said he would do?” First, the difference is that is Congress’ job, not the Executive Branch. We have a Republic, not a dictatorship or monarchy.
Second, because Congress did what they did, doesn’t make it right that Obama did what he did. That bill now is headed to the Senate where Senator Mary Landrieu is a sponsor of the legislation.
One thing to keep in mind about that bill is that it allows insurance companies to offer the previous plans, but does not require them to do so. Many of those companies have cancelled those accounts in anticipation of the ACA rollout.
The American people are getting screwed by Obama all over the place by this fiasco of a health insurance law, which is nothing more than a failed attempt at socialized medicine. When is he going to be held accountable for his criminal actions?
